These Terms of Service ("Terms") govern your access to and use of NestList, a household-centered wishlist service for families. By creating an account, joining a household, using a private share link, claiming an item, pledging toward a group gift, or otherwise using NestList, you agree to these Terms.
If you use NestList on behalf of a household, organization, or another person, you represent that you have authority to do so.
1. NestList At A Glance
NestList helps household owners and co-parents create recipient profiles, manage gift lists, share private links with guests, coordinate claims and group gifts, and draft thank-you notes. NestList is a coordination tool. It is not a retailer, payment processor, escrow service, shipping provider, charity platform, or marketplace.
2. Eligibility
You must be at least 18 years old, or the age of legal majority where you live, to create an account or manage a household. NestList is not directed to children under 13.
Guests may use private share links to view lists, claim items, or pledge toward group gifts. A guest who provides claim or pledge information represents that they are authorized to do so and that the information they provide is accurate.
3. Accounts And Household Roles
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
NestList supports household roles, such as owner, co-parent, and viewer. The household owner is responsible for managing members, permissions, billing, share links, privacy settings, recipient profiles, and household deletion decisions.
If you invite someone to a household, you are responsible for making sure the invitation is appropriate. If you join a household, your access is controlled by the household owner and your assigned role.
4. Recipient Profiles And Authority
NestList lets account holders create profiles for recipients, including children, adults, and pets. Recipient profiles may include names, ages, photos, preferences, addresses, notes, and gift lists.
By creating or editing a recipient profile, you represent that you have the right to provide and manage that information. If the recipient is a child, you represent that you are the child's parent or guardian or that you otherwise have appropriate authorization.
You agree not to add information that is unlawful, invasive, harmful, or more sensitive than needed to coordinate gifts.
5. Private Share Links And Guest Access
Share links are intended to be private. Anyone with a valid active share link may be able to access the linked guest view. You are responsible for sharing links only with intended guests and revoking links when access should end.
NestList may provide tools such as per-recipient address reveal settings and a household share-link kill switch. These tools are designed to help protect privacy, but they do not replace careful sharing.
Guests agree not to misuse share links, scrape list data, attempt to access other households or recipients, or share private recipient information beyond the gift coordination purpose for which the link was provided.
6. Gift Claims, Reservations, And Purchases
Guests may reserve an item, mark an item as purchased elsewhere, release a claim, or pledge toward a group gift. Household members may see claim and contributor information so they can coordinate gifts and thank-yous.
NestList does not guarantee that a gift will be purchased, delivered, reimbursed, available, priced accurately, or suitable for a recipient. Users and guests are responsible for their own purchasing, shipping, delivery, and communication decisions.
7. Group Gifts And Reimbursements
NestList group gifts are coordination records only. NestList does not collect, hold, transmit, settle, refund, or guarantee money for group gifts.
If a household or lead buyer shares Venmo, PayPal, Cash App, Zelle, cash, or other payment information, that information is provided for coordination between the people involved. Any payment, reimbursement, dispute, refund, tax issue, or mistake is between the participants and any third-party payment provider they choose to use.
You agree not to use NestList for fraud, money laundering, illegal fundraising, regulated financial activity, or any transaction prohibited by law or by a third-party payment provider's terms.
8. Subscriptions, Trials, Billing, And Cancellation
NestList is a paid service unless we state otherwise. Subscription plans, prices, billing intervals, trial periods, and included features will be shown during checkout or in the billing settings.
Billing is processed by Stripe or another payment provider we may use. By subscribing, you authorize recurring charges according to the selected plan and payment provider terms. You are responsible for keeping billing information current.
If a free trial is offered, the trial terms will be shown at signup. Unless you cancel before the trial ends, your subscription may begin automatically at the end of the trial.
You can manage plan changes and cancellation through the billing settings or customer portal when available. Cancellation generally takes effect at the end of the current billing period unless the checkout or billing flow states otherwise.
Fees are non-refundable except where required by law or expressly stated by NestList. We may change prices or plan features with reasonable notice as required by applicable law.
9. User Content
"User Content" means information, text, photos, links, addresses, notes, preferences, gift details, claim details, pledge details, thank-you drafts, and other content submitted to NestList by account holders or guests.
You retain ownership of your User Content. You grant NestList a limited license to host, store, process, display, transmit, modify for formatting, and otherwise use User Content as needed to provide, secure, support, and improve NestList.
You are responsible for your User Content and must have the rights needed to submit it. You agree not to submit User Content that is unlawful, defamatory, abusive, invasive of privacy, infringing, misleading, malicious, or harmful.
10. Product URL Prefill
NestList may let you paste a product URL so we can fetch metadata such as title, image, price, currency, and store name. Product metadata may be incomplete, outdated, unavailable, inaccurate, or blocked by the retailer.
You are responsible for reviewing and editing imported details before saving or sharing them. NestList does not guarantee product price, availability, shipping terms, image accuracy, or retailer content.
11. AI Features
NestList may offer AI-assisted features, such as gift suggestions, product enrichment, thank-you drafting, or tone rewrites. AI outputs may be inaccurate, incomplete, repetitive, inappropriate, or unsuitable for your use.
You are responsible for reviewing, editing, and approving AI outputs before relying on them or sending them. Do not submit highly sensitive information to AI features unless necessary. We may limit, suspend, or change AI features to manage cost, safety, quality, or availability.
12. Acceptable Use
You agree not to:
- Access or use NestList for unlawful, harmful, fraudulent, or abusive purposes.
- Attempt to access accounts, households, recipients, lists, claims, or systems without authorization.
- Probe, scan, test, or bypass security or access controls.
- Interfere with, overload, scrape, crawl, reverse engineer, or disrupt NestList.
- Upload malware or malicious code.
- Use NestList to harass, threaten, shame, stalk, or expose private information about another person.
- Use NestList for regulated payments, illegal fundraising, resale schemes, sweepstakes, gambling, or other prohibited transactions.
- Misrepresent your identity or affiliation.
- Violate another person's intellectual property, privacy, publicity, or other rights.
We may investigate suspected violations and take action, including removing content, revoking share links, limiting access, suspending accounts, or terminating service.
13. Third-Party Services
NestList relies on third-party services for functions such as authentication, storage, hosting, email, billing, AI generation, payment-provider links, product URLs, and monitoring. Third-party services may have their own terms and privacy policies.
NestList is not responsible for third-party websites, retailers, products, payment providers, shipping providers, or services linked from or used with NestList.
14. Intellectual Property
NestList, including its software, design, branding, features, and content we provide, is owned by NestList or its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, branding, or software except the limited right to use NestList according to these Terms.
If you provide feedback, suggestions, or ideas, you grant NestList the right to use them without restriction or compensation.
15. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using NestList, you acknowledge that we process information as described in the Privacy Policy.
16. Service Changes And Availability
We may modify, suspend, or discontinue parts of NestList at any time. We may add or remove features, change limits, update plans, or restrict access where needed for security, legal, operational, or product reasons.
We try to keep NestList reliable, but we do not guarantee uninterrupted or error-free service.
17. Suspension And Termination
You may stop using NestList at any time. Account deletion and household deletion options may be available in settings.
We may suspend or terminate access if we believe you violated these Terms, created risk or legal exposure, failed to pay fees, or used NestList in a way that could harm NestList, users, guests, recipients, or third parties.
After termination or deletion, we may retain certain information as described in the Privacy Policy or as required for legal, security, billing, backup, or operational reasons.
18. Disclaimers
NestList is provided "as is" and "as available." To the fullest extent permitted by law, NestList disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security.
NestList does not guarantee gift availability, retailer information, delivery, reimbursement, payment, guest behavior, recipient reaction, address accuracy, AI output quality, or third-party service performance.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
19. Limitation Of Liability
To the fullest extent permitted by law, NestList and its affiliates, officers, employees, agents, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or security incidents, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, NestList's total liability for any claim arising out of or relating to these Terms or the service will not exceed the greater of: (a) the amount you paid to NestList in the 12 months before the event giving rise to the claim; or (b) $100.
20. Indemnity
You agree to defend, indemnify, and hold harmless NestList and its affiliates, officers, employees, agents, service providers, and licensors from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or relating to your use of NestList, your User Content, your violation of these Terms, your violation of law, or your violation of another person's rights.
21. Governing Law And Disputes
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules.
Any dispute arising out of or relating to these Terms or NestList will be resolved in the state or federal courts located in New Castle County, Delaware, unless the parties agree otherwise or applicable law requires a different forum.
22. Changes To These Terms
We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify account holders, such as by email or in-app notice. Updated Terms will be effective when posted unless they say otherwise.
Your continued use of NestList after updated Terms take effect means you accept the updated Terms.
